3.   PROBLEMS PRESENTED BY THE SUPPORT LAWS

(A)   Support Laws Punish Financial Responsibility, And Reward Financial Dependence

    Child support is substantially affected by each party's income or earning capacity. A higher income usually translates into more child support paid, or less child support received. A lower income usually translates into the opposite.

    In other words, the law punishes parents who are more financially productive, by demanding that they pay more or receive less support. The law encourages parents to maintain lower or no income, by allowing them to receive more or to pay less support.

(B)   Parents Are Paid To Sabotage Their Children's Access To, And Parenting From, The Other Parent

    Child support money follows the child. More custody time translates into more child support received, or less child support paid. Hence, each parent is literally paid to minimize or eliminate custody time with the other parent.

(C)   The Government Support Enforcement System Is Severly Over-Burdened And Under-Resourced

    The California Department of Child Support Services ("DCSS") saddles each of its attorneys with thousands of cases.

    Stop and think about this for a minute: One attorney. Thousands of cases. Notice anything wrong with this picture?

    It is therefore virtually impossible for these attorneys to return phone calls, or to provide any other substantial individual attention, absent an act of divine intervention.

    Examples of DCSS mismanagement of some of their cases are legion. Given the inhuman work load faced by their attorneys, this is no surprise.

    Indeed, quite the contrary. Even a thousand of such cases constitutes less than 1% of the DCSS total case load. This is an unusual, if not astonishing, feat for mere mortals. Hence, the only surprise is how little mismanagement there is.
