A.  Judges Are Biased. Sort Of.

    This should not be a surprise to any one. All judges are human beings. All human beings are biased, at least to some extent. Do the math.

    Once appointed or elected, judges are required to attend training. That training involves substantial emphasis on overcoming bias. However, as with all human beings, some learn and apply their training better than do others. Hence, some judges are more successful in overcoming their personal biases and prejudices than are others.

    The trick is to fashion your arguments to exploit what bias remains. 

    No problem. Regardless of the nature and extent of any judge's bias, just about everyone is biased in favor of one category of persons above all others: CHILDREN.

    Therefore, all your arguments should emphasize that which best promotes the interests of your child, and should ignore the interests of yourself and everyone else.

B.  Judges Have ADD. Sort Of.

    As discussed more fully HERE, judges have far too much to do, in far too little time. So keep your arguments and testimony well organized, short, sweet, and to the point.

C.  Judges Are Bored. Sort Of.

    With so many pleadings to read, day after day, year after year, all those black letters on all that white paper can get dull.

    Very, very dull.

    Use photographs, charts, graphs and other exhibits, especially those in color. They will provide a refreshing break from the tedium, and thereby be more likely to grab the judge's attention.
